Another difficult case successfully resolved.
A car crashed into another wrecked car and 18 wheeler on an interstate in Fort Worth late one night in 2016. An oncoming car driven by a young woman did not stop in time and hit the car. Other vehicles on the road then collided. The woman had to be rushed to the hospital with multiple fractures and injuries to her ribs, sternum, internal organs, and ankle.
When she was released, she sought legal representation from several local lawyers who refused to take or keep her case. A huge problem was that the police report blamed her as well as several other vehicles. The driver in front of him claimed he was not at fault. One injury law firm she hired unbelievably called her passenger, filed a claim against her, and received the full policy limit from her liability policy.
The woman was despondent and didn’t know what to do. A year went by. Fortunately, she Googled around and hired Berenson Injury Law. We were willing to take a shot at winning the case that no one else wanted.
Our investigator immediately sprung into action to prove that she was not liable and to obtain the necessary proof. We obtained a statement from the passenger absolving her of blame. The other driver’s insurance company continued to argue that she was to blame for failing to keep a proper lookout, speeding, and for not applying her brakes. There were other problems. We threatened a counter-lawsuit in the one that had already been filed against her by other vehicle drivers.
Mr. Berenson fought hard, proved that the driver in front of her was solely responsible, and forced his company to pay the total available.
He then reduced her medical bills by an astonishing 74%, including making the hospital release its lien that he argued had been improperly filed when she left the first hospital and checked herself into a second more than 72 hours after the statutory period, saving her an extraordinary $121,000!
