Uninsured Insurance and Underinsured Insurance Pays Off!

I am pleased to represent so many wonderful people who have unfortunately gotten injfuries in automobile wrecks, and thought I’d discuss my latest case where I fought to max out my client’s Underinsured Motorists insurance (UIM) benefits of $30,000.00 after obtaining the full amount of $100,000.00 from the at fault driver’s insurance company. Here is how this works and why you should buy this auto insurance.

Under Part C of the standard Texas automobile policy, if you purchase uninsured you also purchase underinsured motorists coverage. Since more than 25% of drivers on the road are uninsured (and I think this number is a lot higher), you should strongly consider adding this coverage to your policy, if you have not already done so. That way, if (God forbid) you are crashed into by a driver who does not carry liability insurance, there will still be a way for you to pay your medical bills and be reimbursed for your lost wages and other damages. I see this happening all the time, especially in this economy.

The more serious problem is when the other driver’s insurance limits (often just $30,000.00 per person or $60,000.00 for everyone injured) are not sufficient to pay for the damages incurred. For example, if surgery is required, medical bills can easily exceed $30,000.00. And sometimes your health insurance carrier tries to get out of paying for these bills, claiming it is secondary to the other driver’s policy, greatly minimizes payment, or pays and then wants to be reimbursed in a concept called subrogation.
