We are pleased that we were able to get the maximum amount of $80,000.00 paid to the young woman driving this car in Fort Worth only five weeks ago. We will also get her another $2,500.00 from her Personal Injury Protection policy.

Unfortunately, a young man in a pick-up truck failed to stop at a stop sign and t-boned her car. The impact pushed the car off the road where it plunged head-first into this drainage canal. Needless to say, she was seriously injured.

The legal work

Her family hired Berenson Injury Law and we jumped into action. Although liability seemed obvious, the truck driver denied that he was at fault. We immediately got the police report and tracked down two eyewitnesses and her passenger and got recorded statements from them. We sent this information to the truck driver’s insurance company and demanded that it accept liability.

We quickly obtained her medical records, x-rays, and bills (most of which were paid by her health insurance), took other action, and demanded that the company immediately pay his entire insurance policy limits or we would file suit.

The result

We got the maximum amount from the at-fault driver of $30,000.00 — the amount that almost every Texas driver purchases, and if he had bought more, we would have fought for that. Then we made her parent’s insurance company pay the total available of $50,000.00 of underinsured motorists benefits. Our client received $51,600.00 (a large 65% of the total) after payment of fees and medical expenses.

And we did this in five weeks, which is extremely fast. Cases like this can drag on for months and even years. With Texas courthouses still almost closed and jury trials set to begin again possibly in September, we did not want our client to have to wait for a lawsuit to get to trial years from now.
