U. S. Supreme Court Hears Lawsuit Brought By Texas and Other States Attacking Constitutionality of New Health Care Reform Law

For the next three days, the United States Supreme Court will hold momentous hearings to consider whether the controversial Patient Protection and Affordable Care Act is legal.

Texas and other states (the number has now grown to 26) filed a lawsuit challenging the new law's constitutionality, especially its key requirement that most Americans buy health insurance or pay a penalty.

As a Fort Worth personal injury lawyer, I have seen that uninsured people usually do not have a way to pay for their large medical bills when they are injured in an automobile accident (or if they are covered, their insurance companies deny or only partially pay for their medical treatment -- and then demand to be repaid), so this decision is especially important to my clients.

Fort Worth Automobile Accidents Caused More By Older Drivers?

Texas ranked second in the U. S. in the number of elder motorists who were killed in motor vehicle collisions, with 397 people unfortunately dying as a result of car crashes in 2010.

As a Fort Worth injury lawyer, I have represented many older drivers over the past 31 years who were hit by careless young drivers (and vice versa), and it is impossible to generalize about the driving habits of any age group. For example, I just concluded a case where a 21 year old woman was crashed into by a 71 year old woman. But I have just been hired in a case where a 16 year old young man was speeding and collided into my 40 year client.

Cyclist Killed By Drunk Hit And Run Driver in McKinney

McKinney police arrested the driver who is accused of hitting a bicyclist at Greenwood Road -- and then fleeing the scene.

Steven Miles, 58, a substitute teacher, was flown to Parkland Memorial Hospital, where he unfortunately died.

Dallas Drunk Driver Driving Wrong Way on I-20 Kills His Passenger and Critically Injures Another Motorist

An intoxicated man who caused a horrible Dallas County automobile crash first thing this morning on Interstate 20 is facing charges for intoxicated manslaughter and intoxicated assault.

Juan Ramon Hernandez, 26, who lives in Irving, will be booked when he is released from Baylor University Medical Center, where he was taken in stable condition.

Hernandez was driving eastbound in the westbound lanes of the highway around 6:00 o'clock a.m. when he crashed his car into another car head-on.

A passenger riding with Hernandez was unfortunately killed in a crash and the driver of other vehicle was transported in critical condition to Baylor University Medical Center.

Tragic Johnson County Accident: Speeding Teenager Kills One Passenger and Critically Injures Another

I hated to read about a horrible automobile accident last night where a young woman from Rio Vista lost control of her car on County Road 1106 west of tis small town and caused the death of Charlotte Tillison, age 18, a senior at Rio Vista High School who also worked at the Braum's in Cleburne.

The driver, Shelbi Misener of Rio Vista -- who had just turned 16 -- and two other passengers, Lance Rejcek, 19, of Rio Vista and Bryan Kiker, 19, of Waco, were ejected in the wreck. They were rushed to Harris Methodist Hospital in Fort Worth. Lance Rejecek is unfortunately reported as being critically injured.

Fort Worth Accident Injures Two People In Yet Another DWI

Around 2:00 this morning, a pick-up was going the wrong way on Highway 121, forcing drivers to swerve to avoid the Fort Worth automobile collision. Unfortunately, a Cadillac was unable to turn in time and was struck head-on by the truck.

Two people were taken to Harris Hospital but the extent of their personal injuries has not been released. Police say they plan to charge the pick-up driver with intoxicated assault.

Wrong way crashes almost always result in very serious injuries or fatalities because of the impact velocity which can easily exceed 70 mph. As a Fort Worth injury lawyer, I have represented several clients hurt

Fort Worth And Dallas Accidents Caused By Some Of Worst Drivers In The U.S. According To New Study

I now know why I am so busy as an automobile accident attorney: according to a study conducted by Men's Health Magazine, Dallas drivers are the second worst in the country, with only St. Louis drivers being worse. And following close behind, Fort Worth drivers were #12 worst. Houston and Austin were both in the top 10. So Texas has four cities in the top 12. Be careful out there!

The study looked at the rate of fatal crashes; percentage of fatalities involving alcohol, speeding, or hit-and-run, the rate of seat belt use, laws on cellphone use while driving, and the average number of years between accidents.

Of the 10 Texas cities surveyed, 6 were in the 20 worst list.

Lawyer Joke Not So Funny

In what sounds like a lawyer joke, yesterday the Oklahoma Supreme Court reversed a defense verdict in favor of two physicians in a medical malpractice case because a juror left the courtroom, walked into a bar, and astonishingly told a total stranger:

1 That he "wanted to play the judicial system,"

2, That he had required the plaintiff to prove her case beyond a reasonable doubt, not just by the proper standard in civil cases of a preponderance of the credible evidence bias, and
