My latest settlement - suit against trucking company

Kathy P___ was sideswiped in her mini van on December 11, 2007 by a Mack truck which skidded into her on a rainy and dark morning. There was no damage to the truck and little to the van's front left quarter panel.

Kathy said that she was okay at the scene and declined an ambulance. A few hours later, she went to the ER complaining of chest pain. A CT showed that she might have damaged her right breast implant. Kathy had unfortunately had breast cancer and needed a double mastectomy and implants 20 years ago.

Kathys PCP referred her to a plastic surgeon, who decided to replace both her right and left implants. Although the right implant procedure was a success, the left one developed problems, and three more surgeries became necessary. Her PCP wrote that she had previous problems with the implant. She was salaried, and lost no wages. Kathy recovered from the surgeries.

The trucking company denied that it was liable, and I filed suit and forced the company to pay Kathy a total of $222,250.00 just before trial.

Fewer wrongful death collisions in U.S.

In the first six months of 2009, deaths on U.S. highways decreased to a record low. "Only" 16,626 people died in traffic collisions, 7% less than the year before.

Fortunately, highway deaths have been decreasing since 2005.

Fewer people driving due to the recession, greater seat belt use, and better made vehicles with air bags and other safety devices are all factors.

President bans texting while driving for federal employees

I recently wrote about this weeks's big Department of Transportation conference investigating how to reduce deadly crashes.

Today, President Obama signed an executive order prohibiting the 4.5 million federal employees, including military personnel, from driving and text messaging.

In addition, the U. S. government wants to ban texting by bus drivers and truckers who travel across state lines. Furthermore, these drivers may be prohibited from uding cellphones while driving, unless an emergency is involved. It is not clear whether onboard computers use will be restricted.

"This meeting is probably the most important meeting in the history of the Department of Transportation," Mr. LaHood said in his remarks concluding the conference.
